Wine club specific Terms and Conditions

Burgundy Cellar Wine Club membership

The Burgundy Cellar and our Wine Club sell wines from Burgundy. Access to these products may not be legal by certain persons or in certain countries, and you are responsible for compliance with your local laws. You cannot be a member of the Burgundy Cellar Wine Club if, by so doing and purchasing wines, you are breaking the law in your country of residence.

By submitting your order electronically to join our Wine Club , you are signing that you have read and understood the Terms and Conditions of both the web site and the Wine Club membership as detailed hereunder,  and you give permission to The Burgundy Cellar to charge you on the basis of your chosen Wine Club membership option for each shipment, including transport and applicable duties and taxes.

  • There are no membership fees for The Burgundy Cellar Wine Club
  • As a member of The Burgundy Cellar Wine Club, you are agreeing to receive at least one (1) case of wine (either 6 or 12 bottles) or multiples thereof (depending on the club option you choose) every 12 months – from deliveries which will be made every six (6) months whilst your Wine Club membership is active.
  • Your membership in the Wine Club also provides that during the year you may receive promotional offers from The Burgundy Cellar.
  • Wines offered through the Wine Club will subsequently be available to Wine Club Members in the Shop. Members will benefit from the following shop discounts and specials
  • Discovery Club membership = 5% discount
  • Explorer Club membership = 10% discount
  • Connoisseur Club membership = 10% discount
  • Special Club selection cases
  • Shop wines can be selected and purchased in multiples of 6 from individual growers – i.e. you can pick and mix from available wines from a single grower within a case of minimum 6 and in multiples thereof

Shipping and delivery

  • Wine Club membership is fully inclusive of shipping costs for most states in the USA. Shipping costs include export customs, international air or ocean freight, US customs clearance and duty, repackaging and US ground delivery via common carrier (UPS or FedEx). There are some states where delivery restrictions and / or additional shipping fees or duties will apply. These are noted on the website checkout screen and will be advised to you on joining the Wine Club if they apply to your address.
  • By law in the USA you must be aged 21+ to purchase alcohol. Alcoholic beverages may only be sold and delivered to persons who are at least 21 years old and the person to whom delivery will be made is at least 21 years old. Wine Club members in USA must be aged 21+
  • Scheduled deliveries are:
    • Spring – within the first 2 weeks of April
    • Fall – within the first 2 weeks of October
  • Specific delivery dates will be made by arrangement in advance.
  • We use specialist partners to legally ship your wines and we will be taking every needed precaution to protect your wines and avoid any risk of damage during transit. If this means storing your wines in a temperature-controlled warehouse until weather is appropriate to ship, we will do so free of charge.
  • It is the responsibility of the Wine Club member to provide a current, shippable, physical delivery address.

Payment

  • As a member you will be billed automatically for your Wine Club selection.
  • Payment for each delivery must be made in full prior to the Payment dates of:
    • 1st January - for Spring delivery
    • 30th June - for Fall delivery
  • Payment for wine Club selections will be taken on the dates as above for initial and all future shipments.
  • If we do not receive payment by these dates we cannot ship your wine and we reserve the right to cancel your Wine Club membership.
  • Payments include the selected wines, the shipping cost to the USA, and all applicable taxes and duties other than any additional charges for specific States of the USA, as noted on The Cellar Club page of our web site.
  • If you are sending a gift, you will be billed on purchase for the total number of deliveries you wish to give.
  • If you are purchasing additional wines from the Wine Shop for delivery with the next scheduled Wine Club delivery you will be billed on purchase for those wines.
  • The Burgundy Cellar will give prior written notification of any material changes to the terms of Wine Club membership and you have the right to cancel your Wine Club membership as noted in these Terms and Conditions.

    Skipping or deferring a delivery

    • Members have the option of choosing to skip a delivery as long as they continue to qualify as a member by purchasing a minimum of 1 delivery of 6 bottles per year and they advise us before the Payment date for that delivery.
    • Members can choose to receive one of the Special Wine Shop offers instead of their regular Wine Club option, in which case they simply need to advise the Burgundy Wine Cellar and make payment of any difference between the cost of the 2 items prior to the Payment date for that delivery.

    Cancellation

    We hope you never feel the need to cancel and want to continue your exploration of our region through our Wine Club, however:

    • Members can cancel Wine Club membership provided you communicate this to us a before the next Payment date, as noted above. Once we have passed the Payment date, we regret we cannot cancel the order. The cancellation will be effective from the next delivery.

    • Termination of Wine Club Membership: The Burgundy Cellar reserves the right to terminate your account and/or any Wine Club memberships at any time, with or without cause or notice, and which shall be effective immediately.

    Customer satisfaction 

    At The Burgundy Cellar your satisfaction is our number one priority. We understand taste in wine is very personal and can vary greatly between individuals. All the wines we feature on The Burgundy Cellar’s website and our Wine Club, are carefully chosen by us as excellent examples of Burgundy wines and we always aim that they meet the highest standards of quality and value.

    Protecting your wines: We use specialists in legally shipping wines; therefore, we will be taking every needed precaution to avoid any risk of damage during transit due to extreme weather conditions. If this means storing your wines in temperature-controlled warehouse until weather is appropriate to ship, we will do so free of charge. These options will be presented to you if the situation arises.

    • Please make sure you open your cases of wine immediately on delivery and check the bottles for possible breakage, loss or wine specific damage like seepage during transit, and let us know by e-mail to info@burgundydiscovery.com with photos, within 36 hours of receipt.
    • In the rare event of this happening your wine will be replaced as soon as possible.

    If you are not happy with any wine supplied by us, by reason of quality, please contact us.

    Orders 

    • All offers made are subject to availability. In the unlikely event that a particular wine selection is currently unavailable, we may substitute a similar wine of equal or greater value in your shipment. If this happens, we will let you know in advance.
    • The Burgundy Cellar has the right to refuse orders for any reason including applicable laws and your payment will not be processed for such orders.
    • The Burgundy Cellar reserves the right to change product pricing (for example if there are changes in USA Import duty - currently 25%) and discounts offered at any time.
    • You will be informed in writing in advance of any revised payment (increased or decreased) being taken by The Burgundy Cellar , and you will have the chance to review, change or cancel your membership should you wish to do so, as long as any cancellation is effected before the Payment dates, noted above, for the delivery from which you wish to cancel.
